JUST IN: IPC's dual candidacy case struck from court roll
The Windhoek High Court has ruled that the case in which the Independent Patriots for Change (IPC) dragged the Electoral Commission of Namibia (ECN) to the Electoral Court after the commission refused to disclose a legal opinion by the attorney general on the issue of dual candidacy, cannot be heard in the Electoral Court.
In a judgment delivered this morning, judge Hannelie Prinsloo struck the application from the roll after concurring with the ECN that it was not an 'electoral issue' and that the Electoral Court lacked jurisdiction to adjudicate on the issue of whether the ECN is entitled to refuse to share its legal opinion with the applicant.
