Man ontvang ‘verkeerdelik’ N$120 000 van GIPF

What was labelled in the particulars of claims filed this year as an "error payment" of N$124,000 into the First National Bank (FNB) account of an incorrect Government Institutions Pension Fund (GIPF) resignation claim beneficiary is a pending matter in the Windhoek High Court, which was scheduled for a status hearing Wednesday.

Die betaling van N$124 000 in die rekening van ’n begunstigde van ’n verkeerde bedankingseis by die staat se pensioenfonds (GIPF), is tans die fokus van ’n siviele hofsaak in die hoërhof in Windhoek.

In die GIPF se eisbesonderhede, beweer hulle dit was ’n foutiewe betaling wat tussen Julie en Augustus 2023 aan Euriku Kapitia betaal is. In die hofsaak eis die GIFP nou die volle bedrag terug.



Wat in die besonderhede van eise wat vanjaar ingedien is, gemerk is as \'n \"foutbetaling\" van N$124 000 in die Eerste Nasionale Bank (ENB) rekening van \'n begunstigde van \'n verkeerde staatsinstellings pensioenfonds (GIPF) bedankingseis, is \'n hangende aangeleentheid in die Windhoek Hooggeregshof, wat Woensdag vir \'n statusverhoor geskeduleer was.





Wat in die besonderhede van eise wat vanjaar ingedien is, gemerk is as \'n \"foutbetaling\" van in die Eerste Nasionale Bank (ENB) rekening van \'n verkeerde staatsinstellings pensioenfonds (GIPF) bedankingseis begunstigde is \'n hangende saak in die Windhoek Hoër Hof, wat Woensdag vir \'n statusverhoor geskeduleer was.





Luidens hofstukke was , wat GIPF beveel het om die verskuldigde bedrag terug te betaal, een van twee individue wie se bedankingseise glo deur die pensioenskema verwerk is.

Kapitia het na verneem word N$118 000 na Letsego Bank- ook betrokke by die regsgeding oorgeplaas, op dieselfde dag wat die geld in sy FNB-rekening oorgeplaas is.

Verkeerde rekening

Op 25 Julie 2023 is Kapitia se bedanking by die pensioenfonds se hoofkantoor ingedien. Die volgende dag is die eis na bewering toegewys aan \'n administrateur, wat slegs as me. Nuuyoma in die dokumente geïdentifiseer is, verantwoordelik vir die bestuur van sulke sake.

Teen 28 Julie het me. Nuuyoma die eis verwerk. Tydens dié proses word beweer dat sy die besonderhede van die regmatige ontvanger, die Kuleni-bewaringsfonds, wat veronderstel was om die N$124 000 te ontvang, verwyder en glo eerder Kapitia se besonderhede ingevoer het.

\"Gebrek aan begrip\"

In reaksie op die regsgeding het Ester Kali, hoof uitvoerende beampte van Letsego Bank, in haar beëdigde verklaring gesê dat GIPF se regseis gebrekkig was. Sy het beklemtoon dat die eis nie Letsego Bank, waarheen die geld oorgeplaas is, betrek het nie, en het aangevoer dat die insluiting van die bank noodsaaklik is vir die saak.

Kali het verder GIPF se begrip van bankwetgewing gekritiseer en gesê: \"Ek word aangeraai dat \'n bank wat bewus is van fondse wat deur \'n derde party in sy kliënt se rekening gedeponeer is—en weet dat die kliënt geen wettige aanspraak op daardie fondse het nie—verpligtend is om stappe te neem om te verhoed dat skade aan die derde party deur die wanaanwending van daardie fondse deur die kliënt te voorkom.”

Sy het bygevoeg dat indien die bank oor sulke kennis beskik en versuim om skade aan die derde party te voorkom, dit as \'n mede-oortreder in die diefstal saam met die kliënt beskou sal word.

In hierdie konteks het Kali, saam met die getuienis wat aan die hof voorgelê is, verduidelik dat Kapitia \'n lening van N$103 000 by Letsego Bank geneem het. Hy het die bank permanente magtiging gegee om die leningbetalings, insluitend enige agterstallige bedrae en opgelope rente, te onttrek.

Toe die N$124 000 in sy rekening inbetaal is, het Kapitia se Letsego-leningskuld op N$91 034 gestaan. Dié bedrag is toe van sy FNB-rekening afgetrek om die skuld te dek.

Kali het gesê: \"Die bank tree op as die ekonomiese tussenganger, bestuur deposito\'s en verleen lenings sonder direkte verwysing na die deposante. Dit onderstreep waarom FNB, as die bewaarder van GIPF se deposito\'s, by die regsgeding ingesluit moet word.\"





According to court documents, Euriku Kapitia, who GIPF has ordered to repay the amount owed, was one of two individuals whose resignation claims were reportedly processed by the pension scheme between July and August 2023.

Kapitia is reported to have transferred N$118,000 to Letsego Bank- also involved in the lawsuit, on the same day the money was transferred into his FNB account.

Wrong account

On 25 July 2023, Kapitia\'s resignation was submitted to the pension fund’s head office. The following day, the claim was allegedly assigned to an administrator, identified only as Ms. Nuuyoma in the documents, responsible for managing such cases.

By 28 July, Ms. Nuuyoma had processed the claim. During this process, it is alleged that she removed the details of the rightful recipient, the Kuleni Preservation Fund, which was supposed to receive the N$124,000, and allegedly entered Kapitia\'s details instead.

\"Lack of understanding\"

In response to the lawsuit, Ester Kali, Chief Executive Officer of Letsego Bank, stated in her affidavit that GIPF\'s legal claim was flawed. She highlighted that the claim did not involve Letsego Bank, where the money was transferred, and argued that including the bank is essential to the case.

Kali further criticized GIPF’s understanding of banking law, stating, “I am advised that a bank aware of funds deposited by a third party into its client’s account—and knowing the client has no legitimate claim to those funds—is obligated to take steps to prevent harm to the third party by preventing the misappropriation of those funds by the client.”

She added that if the bank had such knowledge and failed to prevent harm to the third party, it would be considered a co-wrongdoer in the theft alongside the client.

In this context, Kali, along with the evidence presented to the court, clarified that Kapitia had taken a loan of N$103,000 from Letsego Bank. He had given the bank permanent authorization to withdraw the loan payments, including any overdue amounts and accrued interest.

When the N$124,000 was deposited into his account, Kapitia\'s Letsego loan debt stood at N$91,034. This amount was then deducted from his FNB account to cover the debt.

Kali stated, \"The bank acts as the economic intermediary, managing deposits and extending loans without direct reference to the depositors. This underscores why FNB, as the custodian of GIPF\'s deposits, should be included in the lawsuit.\"
