I have a problem and a question about whether the new chief electoral and referendum officer of ECN is in line with the provision of Section 25, subsection (1) (1A), as amended during 2023, regarding that the registration must take place before 31 August 2024 within a 10-year period, as the President may determine. To the best of my knowledge, Section (2) of subsection (1A) defies the previous provision, unless otherwise rephrased or redefined by legal experts, because the previous described that there must be a supplementary registration before any election, to include those who moved from one constituency to another, those whose documents are destroyed, those who got married in between, and other circumstances, etc., as might be provided by law, etc. . . – Anonymous

A new challenge for employers: The challenges of addiction for employers are well known, for example, alcoholism and drugs. However, most addictions have some sort of rehabilitation program and have some examples of court cases dealing with them. But what is the case with cell phone addiction, in which case the employer loses – I believe, more financially than other addictions? Cell phone addiction has a direct influence on performance, especially in certain office-bound positions. The challenge thus is that such addiction is performance-related, which in itself is a problem to address.

The employee must be charged through a hearing, though dismissal on the first hearing will rarely pass the substantive fairness test, no matter how much evidence the employer submits. This means the employer will have to give a final written warning at the first hearing and set out the way how the performance will be monitored over a period as determined. If the employee still does not comply with the set standards, a second hearing is needed to justify dismissal. Some would argue just to prohibit cell phones in the workplace. Well, cell phones are nowadays part of our lives, even in the performance of our work duties! Compiling charges in such cases is another issue; for example, should elements of dishonesty also be considered? – André Blaauw
